Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MagneticSquares.com and your purchase of products from Magnetic Squares (“Magnetic Squares,” “we,” “us,” or “our”).

By accessing our website, uploading photographs, creating a magnet set, placing an order, or otherwise using our services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the website or place an order.

1. Eligibility and Use of the Website

You must be at least 18 years old, or the age of legal majority where you live, to place an order. If you use the website on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

You agree to use the website only for lawful purposes and not to interfere with its operation, security, accessibility, or other customers’ use of the website.

2. Custom Products

Magnetic Squares creates personalized photo magnets using the images, cropping selections, set size, packaging, gift message, and other options submitted with your order.

You are responsible for reviewing your selections before checkout. This includes confirming:

• The correct photographs have been uploaded.
• Each photograph is assigned to the intended magnet.
• Cropping, positioning, orientation, and zoom are correct.
• Names, addresses, gift messages, and other submitted information are accurate.
• The selected set size, quantity, and packaging option are correct.

The finished product will be based on the final square crops and selections submitted with your order. Elements outside the displayed crop will not appear on the finished magnet.

3. Uploaded Photographs and Your Rights

You retain any ownership rights you hold in the photographs and other content you upload. Magnetic Squares does not claim ownership of your photographs.

By uploading content, you represent and warrant that:

• You own the content or have permission from the rights holder to reproduce it.
• You have any consent reasonably necessary from people depicted in the content.
• Our production and delivery of your order will not violate another person’s copyright, trademark, privacy, publicity, contractual, or other rights.
• The content is not unlawful, threatening, abusive, defamatory, obscene, exploitative, fraudulent, or otherwise prohibited by these Terms.
• The content does not promote violence, hatred, discrimination, illegal activity, or the sexual exploitation of any person.

You grant Magnetic Squares and the service providers involved in producing your order a limited, nonexclusive, royalty-free license to store, reproduce, crop, resize, format, transmit, and otherwise process your submitted content solely as reasonably necessary to operate the website, manufacture and fulfill your order, provide customer support, address quality concerns, or comply with applicable law.

This permission does not allow us to use your photographs in advertising, social-media posts, promotional materials, or public galleries without your separate permission.

We reserve the right to reject or cancel an order containing content that we reasonably believe violates these Terms or applicable law. If an order is canceled for this reason before production, any refund will be handled in accordance with applicable law and the circumstances of the order.

4. Image Quality and Product Appearance

The quality of the finished magnets depends substantially on the quality of the photographs submitted. Images that are blurry, dark, heavily compressed, pixelated, poorly exposed, or captured at a low resolution may not print clearly.

Any image-quality warning provided by the website is intended as a helpful indicator and does not guarantee that all possible print-quality concerns will be identified. If you continue with an image after receiving a warning, you accept the risk that the finished image may appear soft, pixelated, or otherwise less detailed.

Computer screens and mobile devices display brightness and color differently. Minor differences in color, contrast, sharpness, cropping, alignment, finish, or scale between an on-screen preview and the physical product are normal and are not necessarily defects.

Because the magnets are individually produced, slight variations between products or production runs may occur.

5. Orders and Order Acceptance

Submitting an order is an offer to purchase the selected products. An order-confirmation email acknowledges that we received the order but does not necessarily mean that the order has been accepted for production.

We may contact you if we need additional information concerning your photographs, payment, shipping address, or order details. We may refuse, limit, or cancel an order because of suspected fraud, payment problems, technical errors, unavailable materials, prohibited content, an incorrect price, or another reasonable business or legal concern.

If we cancel a paid order, we will issue any refund required by applicable law to the original payment method.

6. Pricing, Payment, and Taxes

All prices are listed in U.S. dollars unless otherwise stated. Product prices, packaging charges, discounts, shipping charges, and available delivery methods are displayed before you complete checkout.

Shipping charges are calculated at checkout based on the order and destination. Magnetic Squares does not offer a universal flat-rate shipping charge.

Applicable sales tax may be calculated and collected based on the order, shipping destination, and legal requirements.

Payments are processed through Shopify and its payment-service providers. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges.

We may correct pricing, description, or availability errors. If an error affects an order you have already placed, we will contact you or cancel and refund the affected order as appropriate.

7. Order Changes and Cancellations

Because every magnet set is personalized and production may begin shortly after an order is submitted, changes and cancellations are not guaranteed.

If you need to request a change or cancellation, contact us as soon as possible at hello@magneticsquares.com and include your order number. We will make a reasonable effort to assist, but an order generally cannot be changed or canceled once production has begun.

A request is not considered accepted until Magnetic Squares confirms it in writing.

8. Production and Shipping

Estimated production and delivery times are provided for convenience and are not guaranteed arrival dates. Most orders are prepared within the timeframe stated on our Shipping & Returns page, but production may take longer during holidays, high-volume periods, equipment interruptions, severe weather, or other unusual circumstances.

Available shipping methods and charges are shown at checkout. Our preferred carrier is USPS Priority Mail, although we may use another carrier or service when appropriate.

Once an order has been transferred to a shipping carrier, delays caused by the carrier, weather, service interruptions, an incorrect address, or circumstances outside our reasonable control may affect delivery.

If we cannot ship within the timeframe promised, we will provide notice and offer the options required by applicable law, which may include agreeing to a revised shipping date or canceling the unshipped order for a refund.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping expenses resulting from an incorrect or incomplete address may be the customer’s responsibility where permitted by law.

9. Returns, Replacements, and Damaged Orders

Because Magnetic Squares products are made specifically from each customer’s photographs, they generally cannot be returned or exchanged because of a change of mind, an unwanted crop that matched the approved preview, or dissatisfaction caused by the quality of the submitted image.

If your order arrives damaged, contains a manufacturing defect, or does not match the order you submitted, contact us within 14 days after delivery. Please include:

• Your order number.
• A description of the problem.
• Clear photographs showing the affected product and, when relevant, its packaging.

After reviewing the issue, we may provide a replacement, reprint, refund, or another appropriate resolution. We may require additional information before approving a remedy.

Nothing in these Terms limits any non-waivable rights or remedies available under applicable consumer-protection law. Additional information appears on our Shipping & Returns page.

10. Lost, Stolen, or Misdelivered Packages

If tracking shows that an order is delayed, lost, or delivered but you cannot locate it, contact us so we can review the shipment information and determine the appropriate next step.

Magnetic Squares is not responsible for delivery problems caused by an incorrect address supplied by the customer, an unsafe delivery location, refusal of delivery, or failure to retrieve a package. However, we will make a reasonable effort to assist with carrier inquiries when possible.

11. Gift Orders and Messages

If you submit a gift recipient’s information or a personalized message, you represent that you have permission to provide and use that information for the order.

Gift messages must comply with the same content standards that apply to uploaded photographs. We may decline to print a message containing unlawful, threatening, abusive, discriminatory, obscene, or otherwise prohibited content.

12. Magnetic Squares Intellectual Property

The Magnetic Squares name, logo, website design, written copy, product presentation, graphics, photographs owned by us, and other original website materials are owned by Magnetic Squares or used with permission.

Except as allowed by law, you may not copy, reproduce, distribute, modify, publish, sell, exploit, or create derivative works from our website or branded materials without prior written permission.

This section does not give Magnetic Squares ownership of customer-uploaded photographs.

13. Third-Party Services and Links

Our website may rely on or link to third-party services, including Shopify, payment providers, shipping carriers, social-media platforms, hosting services, and cloud-storage providers.

Those services may have their own terms and privacy practices. Magnetic Squares is not responsible for third-party websites or services that we do not control. A link or integration does not necessarily constitute an endorsement.

14. Website Availability and Disclaimer

We work to keep the website accurate, secure, and available, but we do not guarantee uninterrupted or error-free access. The website may occasionally be unavailable because of maintenance, technical problems, updates, or circumstances beyond our control.

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. We disclaim warranties not expressly stated in these Terms, but nothing in this section excludes warranties or protections that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Magnetic Squares will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or purchase of a product.

To the fullest extent permitted by law, our total liability concerning a product or order will not exceed the amount you paid for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited or excluded.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Magnetic Squares harmless from third-party claims, damages, or reasonable expenses arising from content you upload, your infringement of another person’s rights, your unlawful use of the website, or your material violation of these Terms.

This provision does not apply to the extent a claim results from Magnetic Squares’ own unlawful conduct.

17. Governing Law

These Terms are governed by the laws of the District of Columbia and applicable federal law, without regard to conflict-of-law principles.

Any dispute concerning these Terms or your use of the website will be resolved in a court with proper jurisdiction, subject to any rights you may have under applicable consumer-protection law.

18. Changes to These Terms

We may update these Terms periodically to reflect changes to our products, website, business practices, or legal obligations.

The revised Terms will be posted on this page with a new “Last updated” date. Changes apply prospectively unless applicable law requires otherwise. The Terms in effect when you place an order will generally govern that order.

19. Severability and No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Our decision not to enforce a provision on one occasion does not waive our right to enforce it later.
